Writing Prizes provides:

Writing Competition Alerts Subscription: A monthly email service that delivers curated lists of upcoming writing competitions across multiple genres. Alerts include competition details, deadlines, entry fees, and prize information.

Digital Products: Downloadable templates, guides, and resources for writers, including book outline templates, character development sheets, submission trackers, and writing prompts. Products are delivered electronically in multiple formats (PDF, DOCX, EPUB).

Free Resources: Blog articles, writing tips, and interactive web-based writing tools available to all Site visitors at no charge.

Accuracy of Information: While we strive to provide accurate and current information about writing competitions, we do not guarantee the accuracy, completeness, or timeliness of any competition listings. Competition details, deadlines, and prize amounts may change without notice. We are not affiliated with the competitions we feature unless explicitly stated.

4. Subscription Service

Billing: Writing Competition Alerts is a monthly subscription service billed through PayPal. By subscribing, you authorize recurring monthly charges to your PayPal account until you cancel.

Cancellation: You may cancel your subscription at any time through your PayPal account or by contacting us at [email protected]. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial months.

Price Changes: We reserve the right to modify subscription pricing at any time. Active subscribers will be notified of price changes at least 30 days in advance. The new price will apply to your next billing cycle after notification. If you do not agree to the price change, you may cancel your subscription before the new price takes effect.

Service Modifications: We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Services.

5. Email Delivery

We use Brevo, a third-party email service provider, to deliver our competition alerts and other communications. While we make reasonable efforts to ensure email delivery, we cannot guarantee that emails will reach your inbox due to factors outside our control, including:

Spam filters and email provider rules
Incorrect email addresses
Full inboxes or delivery limits
Technical issues with email servers

You are responsible for:

Providing an accurate and functional email address
Whitelisting writingprizes.com and [email protected]
Checking spam, junk, and promotions folders regularly
Contacting us if you are not receiving expected emails

We are not liable for missed opportunities or losses resulting from undelivered emails.

6. Digital Products and Intellectual Property

Ownership: All content on the Writing Prizes Site, including but not limited to text, graphics, logos, templates, tools, software, blog posts, and downloadable resources, is the intellectual property of Writing Prizes and is protected by copyright, trademark, and other intellectual property laws.

Limited License: When you purchase a digital product, you receive a non-exclusive, non-transferable, limited license to use the product for your personal writing projects only. This license does not grant you ownership of the product.

Prohibited Uses: You may not:

Resell, redistribute, share, or give away purchased digital products
Post purchased products on file-sharing sites, forums, or social media
Claim authorship or ownership of Writing Prizes content
Modify products and resell them as your own
Use products for commercial purposes beyond your own writing career (e.g., you cannot use our templates to sell template services to others)
Reproduce, copy, or scrape content from our Site without written permission

Violation of these terms may result in legal action, account termination, and a permanent ban from future purchases.

7. User Conduct and Responsibilities

You agree to use Writing Prizes in a lawful manner and comply with all applicable laws and regulations. You agree not to:

Services Provided “As Is”: Writing Prizes provides all Services on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

No Guarantee of Results: We do not guarantee that:

Using our competition alerts will result in publication, prizes, or writing success
Our digital products will improve your writing or lead to specific outcomes
The Site will be uninterrupted, error-free, or secure
Competition information will be accurate or up-to-date at the time you access it

Limitation of Liability: To the maximum extent permitted by law, Writing Prizes and its owners, employees, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Lost profits, revenue, or opportunities
Loss of data or content
Missed competition deadlines
Entry fees paid to fraudulent or misrepresented competitions

Our total liability for any claim arising from your use of Writing Prizes shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is less.

Indemnification: You agree to indemnify, defend, and hold harmless Writing Prizes from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

10. Termination

By You: You may terminate your relationship with Writing Prizes at any time by canceling your subscription and ceasing to use the Site.

By Us: We reserve the right to suspend or terminate your access to the Services at any time, with or without cause, and with or without notice, including but not limited to:

Violation of these Terms
Fraudulent or suspicious activity
Chargebacks or payment disputes
Abusive behavior toward staff or other users
Any conduct we deem harmful to Writing Prizes or other users

Upon termination, your right to use the Services ceases immediately. Sections of these Terms that by their nature should survive termination (including intellectual property provisions, disclaimers, and limitation of liability) shall remain in effect.

11. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to its conflict of law provisions.

Informal Resolution: Before filing a legal claim, you agree to contact us at [email protected] to attempt to resolve the dispute informally. We will make a good faith effort to resolve disputes amicably.

Jurisdiction: If informal resolution fails, you agree that any legal action or proceeding arising from these Terms shall be brought exclusively in the state or federal courts located in Multnomah County, Oregon, and you consent to the jurisdiction of such courts.

Class Action Waiver: You agree to resolve disputes with Writing Prizes on an individual basis only. You waive any right to participate in class action lawsuits or class-wide arbitration against Writing Prizes.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

Update the “Last Updated” date at the top of this page
Notify active subscribers via email
Post a notice on the Site

Your continued use of Writing Prizes after changes are posted constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Services and cancel your subscription.

13. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Writing Prizes regarding the Services.

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment: You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations under these Terms without restriction.
